Partner Terms for Providers
Version of 14 October 2026 · These terms apply to everyone who offers boats via Go2Boat: rental companies and fleet operators connected via a booking system (e.g. MMK Booking Manager, NauSYS), and owners or operators who list their boat directly on Go2Boat, commercially or privately.
1. Parties and subject matter
1.1 The contracting parties are Phaer AG, Grabenstrasse 15A, 6340 Baar, Switzerland, UID CHE-112.167.765, with its product Go2Boat (“Go2Boat”), and the person or company that accepts these terms in the provider Cockpit (“provider”).
1.2 Go2Boat operates the go2boat.com platform, including Cockpits, partner widget and connections to AI assistants (“platform”), and through it arranges contracts for the boat and services between guests and providers. These terms cover the admission of the provider, the presentation of its boats, the arranging of bookings, payment processing and commission.
1.3 Go2Boat is an intermediary, not a lessor. The contract for the boat and services is concluded solely between the guest and the provider. The provider alone is responsible for the boat, crew, handover, safety and performance.
1.4 For connected providers, these terms supplement the approval of Go2Boat’s agency account in the booking system (for MMK: agency ID 4813). In the event of conflict, the information in the booking system prevails for availability, prices, payment plan and agency commission; in all other respects these terms prevail.
2. Admission and verification
2.1 Go2Boat decides at its discretion which providers and boats it admits. There is no entitlement to admission.
2.2 Before activation, Go2Boat verifies the provider in line with the obligations for online platforms (Regulation (EU) 2022/2065, Digital Services Act, Art. 30). For this purpose, the provider supplies, truthfully and completely:
- name or company name, address, phone and email;
- for companies, the extract from the commercial register and the VAT number; for private individuals, an ID;
- boat papers and proof of the right to rent out the boat (ownership or the owner’s power of attorney);
- proof of insurance (section 4.3);
- payment account details (via Stripe, section 7.6);
- a self-certification that it offers only services that comply with the applicable law.
2.3 If this information changes, the provider notifies Go2Boat in the Cockpit within 7 days.
2.4 Commercial or private: On admission, the provider declares whether it rents out commercially (“Professional”) or as a private individual. This information appears on every boat page. A false declaration deceives guests and is unfair. Only the Go2Boat office can change the classification, after verification.
2.5 New providers are admitted on probation until 31 October of the year of their first booking via Go2Boat or until their fifth booking via Go2Boat has been completed, whichever comes first. During probation, they appear as “New to Go2Boat”. Probation is passed if the provider cancels no booking, answers enquiries within the promised time and receives no justified complaint about the handover.
3. Boats, information and content
3.1 The provider lists only boats that exist, that it is allowed to rent out and that are available at the stated time at the stated harbour. It uses photos of the actual boat.
3.2 All information must be true, complete and up to date, in particular capacity (cabins, berths, maximum permitted number of people under the registration), equipment, crew, prices, mandatory extras, costs payable on site, security deposit, cancellation terms, check-in and check-out times.
3.3 Final price without surprises: The price on Go2Boat includes all mandatory costs known at the time of booking. Costs payable on site (e.g. fuel, harbour fees, tourist tax, final cleaning, APA) are itemised with amounts before booking. The provider may not charge the guest any other mandatory costs.
3.4 Freedom of pricing: The provider sets its own prices. Go2Boat requires no price parity and no lowest price.
3.5 One calendar per boat: Directly listed boats keep their calendar in the Cockpit or via iCal sync. The provider keeps it up to date so that no double booking occurs. For connected providers, the calendar of the booking system applies.
3.6 Boat dossier: Connected providers may additionally maintain their presentation on Go2Boat (texts, photos, order, highlights). Availability, prices and payment plan continue to come solely from the booking system.
3.7 Right of use: The provider grants Go2Boat a simple, free-of-charge, worldwide right, limited to the term of the collaboration, to show, translate, shorten and technically adapt photos, texts, layouts and boat data on the platform, in the partner widget, in AI assistants and in search engines. This right also applies to advertising outside the platform (e.g. ads, advertising feeds, social media) unless the provider opts out in the Cockpit. The provider warrants that it may grant these rights and that persons depicted have consented.
3.8 Go2Boat may translate information from real data and standardise its wording. The provider checks its boat page and reports errors. Go2Boat does not invent any information and promises nothing the provider has not confirmed.
4. Provider’s duties in performing the booking
4.1 The provider hands over the boat as booked: at the agreed time, at the agreed place, in a clean, seaworthy condition that complies with the contract, with the required safety equipment and, where booked, with qualified crew.
4.2 The provider complies with all regulations that apply to the boat, the rental and the sailing area, in particular registration, permit for commercial rental, crew licences, maximum number of people, taxes and charges.
4.3 Insurance: Throughout the collaboration, the provider maintains liability insurance for the boat that covers rental to third parties and, for rentals without crew, additionally hull insurance. It provides proof of this on request.
4.4 Security deposit: The provider collects and manages any security deposit itself, never Go2Boat. Its amount is stated before booking (for connected providers, from the booking system).
4.5 Enquiries: The provider answers enquiries and options within the time stated in the Cockpit. The response time is measured and displayed.
4.6 Failure by the provider: If the provider cannot fulfil a confirmed booking, it notifies this immediately and offers an equivalent replacement boat. If the guest does not accept it or none is available, the provider refunds the full amount in money. For directly listed boats, Go2Boat refunds from the amount not yet paid out (section 7.3).
4.7 If the provider cancels a confirmed booking for reasons other than force majeure or the guest’s conduct, it owes Go2Boat the commission that would have been due had the booking gone ahead. Repeated cancellations affect the ranking and may lead to blocking (section 12).
4.8 For rentals by private individuals, the “Go2Boat Terms for Rentals by Private Individuals”, in the version shown to the guest at booking, apply towards the guest. By accepting these terms, the private provider accepts them. Commercial providers upload their own terms, which are shown before booking.
5. Arranging bookings, booking and contact
5.1 Go2Boat offers the provider’s boats on the platform, via Agents, the partner widget and AI assistants. Agents bring guests to Go2Boat; Go2Boat pays their remuneration out of its commission. This causes the provider no additional costs.
5.2 Depending on the boat, bookings are instant bookings or requests confirmed by the provider. For connected providers, Go2Boat places options and bookings in the booking system.
5.3 Contact details only after the deposit: Go2Boat releases the name, phone, email and address of guest and provider only once the deposit has been received. Until then, all communication runs via the platform.
5.4 Messages, offers and boat texts are checked for contact details before they are sent. Phone numbers, email addresses, web addresses, social media profiles and company names are hidden, including in disguised form.
5.5 After the booking, too, communication runs via the platform wherever possible, so that Go2Boat can help if problems arise.
6. Commission
6.1 No fee for the guest. The guest pays the provider’s price, no more. Go2Boat earns only the commission under this section.
6.2 Connected providers: Go2Boat receives the agency commission the provider grants in the booking system. No further fee is charged.
6.3 Directly listed boats: The commission is calculated on the booking price. The commission rates are set out in the «Conditions Sheet». It forms part of this contract and is available in the provider cockpit after registration and before these terms are accepted. The following apply:
- the standard rate;
- the rate for first partners who register by the cut-off date in the Conditions Sheet, for the period stated there from their first booking via Go2Boat, then the standard rate;
- the rate for the provider’s own customers. These are bookings via an offer or storefront link of the provider where the guest had no recorded contact via Go2Boat in the preceding 30 days (search, landing page, Agent, AI assistant). Go2Boat does not promote other boats to these guests.
6.4 No commission on pass-through items: APA, security deposit, fuel, harbour and national park fees, tourist tax, VAT and crew (skipper, hostess, cook, deckhand). Other chargeable extras (e.g. water sports, transfer, catering, bed linen) bear the commission on the booking price.
6.5 The provider grants and funds discounts. The commission is based on the price the guest actually pays.
6.6 Cancellation: If a booking is cancelled, the provider owes commission only on the amount it keeps under its cancellation terms. Section 4.7 remains reserved.
6.7 Go2Boat bears the costs of the payment service. The provider bears fees for refunds and chargebacks for which the provider is responsible.
6.8 In the Cockpit, the provider sees for each booking the guest price, commission, pass-through items, payout amount and payout date. The commission is subject to VAT, where VAT is owed.
6.9 Go2Boat announces changes to the commission rates at least 30 days in advance in the Cockpit and by email. They apply only to bookings received after they take effect.
7. Payment and payout
7.1 Collection: The provider instructs Go2Boat to accept guests’ payments in its name and on its behalf via the payment service Stripe. By paying Go2Boat, the guest has discharged their payment obligation towards the provider to the corresponding extent. The provider does not demand any further payment from the guest for amounts paid via Go2Boat.
7.2 Connected providers: The agency payment plan in the booking system applies. Go2Boat transfers its instalments, from which the agency commission has already been deducted, to the provider by SEPA on time, to the extent the guest has paid the corresponding amounts to Go2Boat.
7.3 Directly listed boats: The provider sets the deposit and balance due date for each boat (standard: 50 % on booking, balance 30 days before the booked period begins). Go2Boat pays out the amount collected, less commission, 24 hours after the confirmed handover. If the handover does not take place, Go2Boat refunds to the guest from this amount what the guest is entitled to under these terms or the provider’s terms. If the guest cancels, Go2Boat pays the provider the amount the provider keeps under its cancellation terms, less commission, within 14 days of the cancellation.
7.4 Set-off: Go2Boat may set off commissions, refunds to guests, chargebacks arising from the provider’s performance, and other claims due against payouts. If the amount is insufficient, the provider pays the remainder within 30 days of invoice.
7.5 Go2Boat never refunds guests from its own funds what the provider owes. If Go2Boat has nevertheless paid on the provider’s behalf, it is entitled to reimbursement.
7.6 Payouts are made via Stripe Connect. For this purpose, the provider opens a Stripe account and accepts Stripe’s terms. Without a Stripe account, Go2Boat pays out by bank transfer. Stripe carries out the identity verification for payouts.
8. Protection against circumvention
8.1 The provider does not conclude contracts for the boat and services with guests it came to know via Go2Boat bypassing the platform, and does not invite them to do so. This applies from the first enquiry via Go2Boat until 24 months after the last contact via the platform.
8.2 The provider does not attempt to exchange contact details before they are released, including in disguised form, in images, documents or boat texts.
8.3 If such a contract is nevertheless concluded bypassing the platform, the provider owes the commission that would have been due on a booking via Go2Boat, at least at the standard rate under section 6.3, plus a contractual penalty of the same amount, at least €500. Further damages remain reserved.
8.4 The system flags repeated attempts and reports them to the office. Go2Boat may issue a warning, temporarily hide boats or end the contract under section 12.
8.5 Section 8.1 does not apply to guests who were demonstrably the provider’s customers before their first contact via Go2Boat, or to own customers under section 6.3.
9. Ranking, labelling and reviews
9.1 Ranking: The order in search results depends mainly on how well an offer matches the search (location, period, number of people, boat type), real availability, price, completeness and quality of the boat page, equipment, year of build and the provider’s reliability (response time, cancellation rate, reviews, Super Owner status, Go2Boat Reliability under section 9.4a). Boats on probation receive no ranking advantage. The main criteria are also described publicly (Regulation (EU) 2019/1150, Platform-to-Business Regulation, Art. 5).
9.2 “Recommended”: Go2Boat may highlight individual boats per region. They are marked “Recommended” and are selected by region, availability and quality of the offer. Go2Boat may highlight boats in which Go2Boat or persons associated with it have an interest of their own regardless of these criteria; these boats also carry the “Recommended” label. Go2Boat does not currently offer paid placement. If it introduces it, paid placement will be labelled and described in these terms beforehand.
9.3 Super Owner: The status is awarded to providers that meet measurable criteria (response time, cancellation rate, reviews). The criteria are shown in the Cockpit.
9.4 Reviews: After the time on board, guest and provider review each other; both reviews are published at the same time, no later than 14 days after the booking ends. Only the guest and the provider of a booking completed via Go2Boat can leave a review. The provider may respond to any review publicly and factually and report it via “Report review”, stating the reason and providing evidence. Go2Boat decides and hides reviews that are unlawful, untrue or used as a means of pressure. The provider offers nothing in return for reviews, writes none of its own and does not arrange fake ones. It reviews guests truthfully and factually; it reports incidents (e.g. damage, no-show) with evidence. 9.4a Go2Boat Reliability: Every verified provider starts with three buoys. One buoy is lost for each substantiated case (cancellation by the provider, boat not as described, date not available, handover failed), and also for a persistently low confirmation rate, slow responses or few guests who would book again. A case counts for 6 months or until 5 further bookings have been completed without a case. Providers with more buoys appear higher up; with one buoy, boats can be booked on request only; with no buoy, they are not shown until Go2Boat has verified the provider. The provider can see the cases in the Cockpit.
9.5 Data: In the Cockpit, the provider sees all data on its boats and bookings (views, enquiries, bookings, turnover, payouts, reviews). It receives data about guests to the extent required to perform the booking. Go2Boat uses aggregated data from all providers to improve the platform and to publish its own market data (e.g. price index per region), without making individual providers identifiable. After the contract ends, the provider receives, on request, a statement of its bookings, commissions and payouts within 90 days.
10. Data protection and confidentiality
10.1 Go2Boat and the provider are each independently responsible for their own processing of personal data (Swiss Federal Act on Data Protection, GDPR). The provider uses guest data only to perform the booking and to fulfil statutory obligations, not for advertising, unless the guest has consented.
10.2 The provider processes IDs and crew lists confidentially and deletes them as soon as there is no longer any retention obligation.
10.3 Both parties treat the other party’s non-public information as confidential (e.g. terms, booking figures, business data), also after the contract ends.
11. Liability and indemnity
11.1 Go2Boat is liable for arranging bookings and processing payments with due care. Go2Boat is not liable for slight negligence, to the extent permitted by law. Otherwise, liability is limited to the commission Go2Boat received from the provider in the 12 months before the event causing the damage. Go2Boat is not liable for loss of profit or indirect damage. Mandatory liability for intent, gross negligence and personal injury remains reserved. The obligation to pay out amounts collected under section 7 is not a liability and is not limited by this section.
11.2 Go2Boat does not warrant any particular number of bookings or uninterrupted availability of the platform or of the connection to booking systems.
11.3 The provider indemnifies Go2Boat against all third-party claims based on its information, its content, the performance of the booking, the condition of the boat, its crew, missing permits or insurance, or on taxes and charges, including reasonable legal defence costs.
12. Term, blocking and termination
12.1 The collaboration begins on acceptance of these terms and runs for an indefinite period.
12.2 Either party may terminate on 30 days’ notice to the end of a month. Confirmed bookings are processed under these terms.
12.3 Either party may terminate without notice for good cause. Good cause for Go2Boat includes, in particular, false information on admission, circumvention under section 8, fake reviews, repeated cancellations, endangering guests or a breach of the law.
12.4 Go2Boat may temporarily block individual boats or the provider if there is specific suspicion of good cause or information is missing. Go2Boat gives reasons in writing (email suffices) for every restriction, block and termination, and gives the provider the opportunity to comment.
12.5 The office receives complaints via the Cockpit or support@go2boat.com and answers them within 10 working days. To reach an out-of-court settlement, either party may request mediation under the Swiss Rules of Commercial Mediation. Each party bears half of the costs.
13. Changes to these terms
13.1 Go2Boat announces changes at least 30 days before they take effect, in the Cockpit and by email, and highlights the changes.
13.2 The provider confirms the new version in the Cockpit. If it does not agree, it may terminate without notice until the changes take effect. If it neither confirms nor terminates, Go2Boat may suspend new bookings for its boats from the date the changes take effect until it confirms.
13.3 Existing bookings remain subject to the version in force when they were received.
14. Electronic conclusion
14.1 These terms are accepted electronically in the Cockpit. Go2Boat stores the full wording, its checksum, the time, IP address and name of the accepting person, and sends a PDF copy by email. The parties recognise this acceptance as binding (Art. 11 CO, freedom of form) and the stored data as evidence.
14.2 Anyone accepting on behalf of a company confirms that they are authorised to represent it.
15. Final provisions
15.1 The German version is authoritative. Versions in other languages are provided for ease of understanding. In the event of discrepancies, the German version prevails.
15.2 If any provision is invalid, the remainder remains valid. It is replaced by a provision that comes closest to its purpose.
15.3 The provider may transfer rights and obligations under this contract only with Go2Boat’s consent. Go2Boat may transfer the contract to a company that takes over the platform. The provider will be informed of this and may then terminate without notice.
15.4 These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-laws rules. Mandatory provisions at the provider’s registered office remain reserved.
15.5 The place of jurisdiction is Baar (Canton of Zug), Switzerland, unless a mandatory place of jurisdiction applies. Go2Boat may also sue the provider at its registered office.
